Let's reduce it right down to the heart of the matter, and enact a "tl;dr" right off the bat:
Both sides are wrong.

First, US Copyright Law works differently from Japanese Copyright Law. Over in the US, Copyright makes it pretty clear that you cannot profit off of an officially licensed property whatsoever unless you are given explicit permission by the parent company.

Trying to do so without that permission, even if it's a fan work (read: Doujinshi) means that you can and will face charges for it. At the very least you will get a cease and desist. So the idea that someone else who doesn't even OWN the property could sue you (for a million dollars, no less) for 'breaking copyright' of something they still don't own is laughable. You aren't going to be able to sue anyone in the US over this unless TYPE-MOON or Delight Works backs you up on it. And I guarantee you they won't unless they're getting a much larger chunk of that money.

That being said. It's a little different over in Japan. Doujinshi and Fanworks actually can be sold for profit without violating copyright laws. And yes, that includes MMD models.

I would say that if you hate pirates so much, making it so your products are on sites that are unreachable without a VPN requiring you to change your IP address just to even access the site *period* is not an answer, and leads to this exact problem in the first place.

That doesn't make piracy right. But if you make it next to impossible for people to purchase your product, then OF COURSE the only examples you're going to hear of are the people that pirate your product.

It is what it is. I'm of the opinion that the model shouldn't have been pirated, but threatening isn't going to make it go away. Politely request that it is removed. Additionally, if you're worried about damaged relations, this isn't a good look for you, coming in like a mafia (or yakuza) demanding compensation.

This is why neither side is right.

The author of this model doesn't hold the rights to the character in the first place, and they're charging money for a model of her. It's scummy to begin with.
